1. Breeding Privilege. The Stallion Owner hereby reserves for the benefit of the Mare Owner one season's booking to the Stallion during the 2024 Breeding Season. The Mare Owner agrees to make the Mare available for breeding through the end of the Breeding Season if necessary to settle the Mare in foal. If not used during the Breeding Season, the Mare Owner shall have a right of return in the subsequent breeding season. If unused in 2 consecutive seasons, the breeding privilege will lapse on the final day of the second season. If the breeding privilege is which is the subject of this Breeding Contract, is being exercised by a person other than the listed Mare Owner, prior approval is needed for the transfer of this contract.
2. Condition and Treatment. The Mare Owner agrees that the mare is healthy and in sound breeding condition and registered with the American Quarter Horse Association. If the mare is not registered with AQHA but is registered with another agency, Jockey Club or American Paint Horse Association, additional administrative fees shall apply to cover registration costs. The Mare Owner agrees to furnish a copy of the Mare's registration papers when returning this contract.
3. Limited Live Foal Guarantee. Each breeding privilege will be accorded a limited live foal guarantee. If a live foal does not result from the exercise of the breeding privilege, the Mare Owner will be entitled to a right of return with the same mare or a substitute mare to the Stallion during the following breeding season only and such return breeding will not be accorded a limited live foal guarantee. The term "live foal" means that the foal resulting from the exercise of the breeding privilege stands alone and nurses. The limited live foal guarantee will be void unless the Mare Owner advises the Stallion Owner within 48 hours after the time of foaling or aborting that the Mare bred to the Stallion did not produce a live foal. After such advice, the Mare Owner must provide within 14 days documentation that the delivery was attended, and a statement by a licensed veterinarian giving the particulars required to substantiate the failure of the mare to produce a live foal. The limited live foal guarantee will terminate if the Stallion dies, is stolen, becomes sterile, or is otherwise incapacitated or if the pregnant Mare is transported from the continental United States.
4. Certificates and Assignment. It is the obligation of the Mare Owner to notify the Stallion Owner that the mare has successfully settled in foal from the breeding privilege. Mares left off the stallion breeding report are subject to additional fees to the Mare Owner to cover late fees and additions to any Stallion Breeding Reports. The Stallion Owner will issue a service certificate or Foal Registration Application on the request of the Mare Owner at any time after the mare has produced a live foal and all charges have been paid in full. 5. Miscellaneous. It is further agreed that if the Stallion dies, or becomes incapable of servicing mares for any reason, this Agreement will become null and void, and the parties will be released from further liability. This Agreement will be construed in accordance with the internal laws of the State of Louisiana. This agreement shall be binding and cannot be amended except in writing executed by each of the parties.
